Therefore the company has implemented this privacy policy that satisfies the security measures required by the General Data Protection Regulation 2016/679, April 27th, concerning the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and by the Organic Law 3/2018, of December 5th, concerning Protection of Personal Data and guarantee of digital rights; all these to ensure the privacy of Users and with the aim to be transparent about the use of this data or information.

1. IN WHICH SECTIONS OF THIS WEBSITE DOES QBITIA COLLECT USERS’ PERSONAL DATA?

a). – Through the corporate emails

Through this email addresses: info@qbitia.com; dataprotection@qbitia.com, sales@qbitia.com Users can write Qbitia and/or request the information they consider necessary to clear up the doubts related to the services offered and the operability of this website, blog or data protection policy.

b). – Through the contact form

In the form to be completed when contacting Qbitia through the platform and in the FAQ section, Users must introduce their personal data in the enabled fields where the name and e-mail address are required.

c). – Through the registration form

Users also have the option to register on the platform through the option “Create an account” by providing a name and a surname, an email address and a password.

d). – Through Qbitia’s blog

In the different articles of Qbitia’s blog its Users can write comments, so that they will provide their name and email address.

e).- Through social networks

Qbitia can collect Users’ personal data through their user profile on social networks in which Qbitia has corporative profiles. Those are detailed in section 10 of this policy.

f). – Collection of data of companies or professionals

If a User contacts Qbitia but acts on behalf of a legal entity or is an independent professional, Qbitia will also collect their personal data for the provision of the requested service and may also treat them for commercial or marketing purposes after specific consent, for example, by validating this Privacy Policy.

In several of these ways of contact we could collect other contact details about you that we could use for the purposes herein described.

 

2. OBJECTIVE AND/OR PURPOSE OF DATA COLLECTION

The purpose of data collection in all the sections previously mentioned is to maintain a direct and personalized contact with Users. In this way, Qbitia will use personal data to answer any question or information they may require, manage their requests and guarantee an experience that respects the highest standards.

The email they provide Qbitia when writing to corporate emails – or the personal data they provide through the contact form – will be used by Qbitia to send them information related to doubts or concerns these Users may have. The email will be also used to inform about updates, upgrades, and for keeping in touch if needed by parties.

Qbitia may also process personal data for advertising and commercial prospection purposes if Users expressly show their consent at the indicated time. Commercial purposes are described at the following paragraph.

In no case Users will receive information from third parties without having been informed about and then requested their express prior consent, nor any international transfer will be made that has as an object Users’ personal data. All these aspects have been implemented to ensure the compliance with the European regulation standards.

3. USE OF PERSONAL DATA PROCESSING AND COMMERCIAL PURPOSES

Qbitia informs Users that the personal data they provide (specially the email address) will be processed for the purposes set in section one which will be, in detail, the following ones:

  1. To attend and resolve the requests or doubts required (commercial or non-commercial, i.e. doubts about functioning of the product but also about prices or similar) by any of the ways of contact shared by the client with our company.
  2. To allow access to registration options, in which case Users must heed the conditions established.
  3. To follow, periodic monitoring and also to know by Qbitia the movements, interests and appointments made between Qbitia and the client in order to offer the best service.
  4. Commercial uses:
    1. To be informed about news that Qbitia may contain in this website.
    2. To send information that is interesting for Users like news related with our services or sector in the market, events we organised, or we participate, among others…
    3. To notify the promotional agreements that Qbitia has subscribed with companies, professionals and/or collaborating associations to offer its Users certain functionalities to those they already have acquired.
    4. To be subscribed to our newsletter where we could inform Users about the mentioned above in points 3 to 5, among others

Qbitia informs Users about the following: (i) their personal data will not be used for purposes other than to carry out the treatment expressly consented at the time or for what is established in this policy on Qbitia’s part; (ii) all this information is stored on an independent secure server.

Qbitia also prevents Users that the information they provide through the website may reveal or allow others to deduce their nationality, ethnicity, gender, age or other aspects of their private life. In this way by providing this information in a totally voluntary way Users are expressly and voluntarily accepting this Privacy Policy.

 

4. ABOUT SHARING INFORMATION WITH THIRD PARTIES

Qbitia will not provide the personal data of Users to third parties. If Qbitia wishes to do so Users will be informed in advance and their consent will be fully requested.

 

5. LEGAL BASIS: EXPRESS CONSENT FOR THE PROCESSING OF PERSONAL DATA

5.1. Consent of natural persons

In compliance with the requirements of the General Data Protection Regulation 2016/679, the Organic Law 3/2018, of December 5th, concerning Protection of Personal Data and guarantee of digital rights and in accordance with the provisions of Qbitia’s internal policies, each time Users send their personal data they must give their express consent by clicking on the box that appears at the bottom of each form where their personal data is collected.

In other cases, when Users write to Qbitia’s contact email or any other enabled form for specific functions of the website, they will be expressly accepting that Qbitia is able to collect their personal data for the purpose or request they have indicated.

Users when these situations are occurred are freely and unequivocally manifesting they agree on the processing of their personal data in accordance with purposes mentioned herein.

Users guarantee that the personal data provided to Qbitia is truthful, so they are responsible to communicate any changes.

The acceptance of Users’ personal data being treated with the purposes referred to in this Policy is always revocable, without retroactive effects, in accordance with the provisions of the current legislation; therefore, Users have the right to withdraw this consent at any time without affecting the legality of the treatment based on the prior consent, by using the means provided in section 6.

5.2. Consent of companies or professionals on processing their personal data

Qbitia informs their Users that, if they act on behalf of a legal person or as an independent professional, they will authorize Qbitia to send them information associated with the contracted services, on the one hand, or commercial information, on the other hand, at the appropriate moments through the acceptance of this Privacy Policy.

Thus, when Users register or request any information related to Qbitia through the channels established by the company in the website, their information may also be processed for commercial purposes and to send electronic communications when authorized.

6. ABOUT ACCESS, RECTIFICATION, SUPPRESSION, OPPOSITION, PORTABILITY, ERASURE AND RESTRICTION OF PROCESSING RIGHTS

GDPR and the Organic Law 3/2018, of December 5th, concerning Protection of Personal Data and guarantee of digital rights have implemented such legal guarantees that allow Users to exercise their rights and actions related to the processing of their personal data.

Qbitia offers the Users these legal guarantees, so that, at any time and/or when they deem it appropriate, Users can make use of their rights of Access, Rectification, Suppression, Opposition, Portability, Erasure and Restriction of processing by writing to the contact email Qbitia has enabled for it: dataprotection@qbitia.com or by sending a request to Avenida Do Conde de Bugallal, 61 D, 2º – A, PC: 36004, Pontevedra (Spain). In both cases must be attached a copy of the passport or their ID (personal data’s User) and to indicate the request they’d like to make: access, rectification, suppression, opposition, portability, erasure or restriction of processing.
It’s important that Users take care about the information they have shared with other Users. Qbitia is exempt from any liability in relation to the elimination of this information.

In the same way, the company does not control the system of renewal of the search mechanisms of third parties. This could contain certain information of the public profile that has already been cancelled by Qbitia but that still appears on the Internet. In that situations Qbitia recommends Users to contact the responsible for these platforms to request the forgotten or erasure right.

Qbitia briefly explains what meaning of Users’ rights are:

AccessBy exercising this right Users can know which personal data are being processed by the company: its purpose, origin or possible transfer to third parties
RectificationThis right consists the option or possibility to modify inaccurate or incomplete personal data by specifying in the request the data must be modified.
SuppressionIt allows the cancellation of the Users’ personal data by inappropriate or excessive when it is possible in accordance with the Law.
OppositionUsers can object to the non-processing of their data in cases such as: advertising and commercial prospecting activities or when such treatment is aimed at the adoption of a decision referred to them and based solely on an automated processing of their personal information
PortabilityUsers can receive their personal data provided in a structured way, commonly used and machine-readable, and they have the right to transmit those data to another controller
Erasure Users shall have the right to obtain from the controller the erasure of personal data concerning them without undue delay. The controller shall have the obligation to erase that personal data without undue delay. For example: Users withdraw consent on which the processing is based, or the personal data have been unlawfully processed
Restriction of processing Users shall have the right to obtain from the controller the restriction of processing where one of the following applies:
– (a) the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;
– (b) the processing is unlawful, and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;
– (c) the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims;
– (d) the data subject has objected to processing pending the verification whether the legitimate grounds of the controller override those of the data subject.

 

Likewise, Users have the right to submit a claim to the competent Control Authority if they consider that the processing of their personal data violates the provisions of the legislation and regulations on data protection; all without prejudice to any further administrative appeal or legal action.

Also, Users are informed that the data processing will not aim to make decisions about their information based solely on automated processing -automated decisions- including the elaboration of profiles, that is, it does not include the elaboration of profiles in an automated way -and without human intervention- of Users’ personal data to evaluate personal aspects related to their person, such as analysing or predicting aspects related to economic situations, health, personal preferences or interests, reliability or behaviour…; all this to the extent that it has legal consequences or significantly affects Users.

In any case, all this would only apply if required by law and Users would have such treatment subjected to appropriate guarantees, including information specific to their person and the right to obtain human intervention, if appropriate; also, to express their point of view, to receive an explanation of the decision made after such evaluation and to appeal the decision, when appropriate.

To be a User of this Platform people must be almost 18 years.

 

8. SECURITY MECHANISMS IN PERSONAL DATA COLLECTION

To guarantee the security of this website, Qbitia has integrated a security system that allows to maintain the confidentiality and integrity of Users’ personal data that have been sent or collected through the means mentioned in the first section of this Policy.

Qbitia also maintains the security levels of protection of its data required by the GDPR and the Organic Law 3/2018, of December 5th, concerning Protection of Personal Data and guarantee of digital rights and has provided all the technical means at its disposal to prevent loss, misuse, alteration, unauthorized access and theft of the data provided by the User through the Platform.

Users also understand and accept that security measures on the Internet are not impregnable and therefore they’re obliged to adopt the necessary security measures that allow them to trust in the veracity of the website in which they are entering their personal data.

Qbitia will always also do its best to guarantee the privacy and security of their Users’ identification data by always using the utmost diligence and by implementing the necessary measures.

Qbitia inform its Users that they will be solely liable for the security measures they implement in relation to the protection of their personal data so Qbitia is not liable for situations where Users have not implemented the security measures that correspond to them; nor of its consequences as well as for any causes or damages caused by third parties unrelated to the company, including fortuitous cases and/or force majeure.

In accordance with the above, the company cannot guarantee that unauthorized third parties may have knowledge of the class, conditions, characteristics and circumstances of the use that Users make of the services offered on this Platform. However, conditions and terms of use have been set in Qbitia’s Legal Notice.

 

9. DEADLINE OF USERS’ PERSONAL DATA CONSERVATION

The personal data provided will be kept for the time necessary to fulfill the purpose for which data are collected and to determine the possible liabilities that may arise from the purpose, in addition to the periods that derive from the applicable legislation.

 

10. POLICY IN SOCIAL NETWORKS

Qbitia has a corporate profile on Twitter and Linkedin social networks. So, by virtue of the provisions of the General Data Protection Regulation 679/2016, the company is a “controller of the processing of Users’ personal data” due to the existence of such profiles in social networks and the fact that Users can follow the company and vice versa.

If Users decide to join Qbitia’s corporate profile as a follower or giving a “Like” to Qbitia’s content or profile, they must accept this policy where Qbitia explains rights and uses of data.

As the party responsible for the processing of Users data, Qbitia guarantees confidentiality in the processing and compliance with their rights, always under the effects of the mentioned Regulation.

On the other hand, Qbitia inform their Users that social networks will be used to announce news or relevant information related to the services Qbitia provides or on topics that Qbitia considers that are interesting.

Using the functionalities of these platforms, Users may receive news with this type of information on their timeline or in their profile.

However, Qbitia also informs its Users that there is no relation between Qbitia and such platforms or social networks, so Users will accept the corresponding use and conditions policy once they access those social networks and validate when registration is done.

Qbitia will not be responsible for the use or treatment of personal data made outside the strict relationship and provision of services indicated in this policy.

12. MODIFICATION OF THIS PRIVACY POLICY

Qbitia reserves the right to modify this policy to adapt it to future legislative or jurisprudential developments, as well as to future uses that would possibly make of Users’ personal data on this website. Just in case that this modification affects the Users in relation to the processing of their data, for example, because Qbitia’s going to make additional uses of personal data not informed in advance, Qbitia would notify its Users and will ask for their permission if needed.
